1. Introduction

Welcome to NebulaClient ("Nebula," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of NebulaClient, a Minecraft client modification ("Mod") that may be used free of charge or purchased for premium features (the "Service"). By downloading, installing, or using NebulaClient, you ("User," "you") agree to comply with and be bound by these Terms. If you do not agree, you may not use the Service. Your use of NebulaClient is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data in compliance with the GDPR.

NebulaClient is not affiliated with Mojang AB, Microsoft Corporation, or Minecraft. Minecraft is a registered trademark of Mojang AB.

2. Acceptance of Terms

By using NebulaClient, you confirm that:

  • You are at least the higher of 13 years old or the minimum age of digital consent in your jurisdiction.
  • If under 18, you have parental/guardian consent to use the Service.
  • You will comply with these Terms and all applicable laws.

3. License and Access

3.1 Grant of License
Subject to these Terms, Nebula grants you a limited, non-exclusive, revocable, and non-transferable license to:

  • Download, install, and use the free version of NebulaClient.
  • Purchase and access premium features (if applicable).

3.2 Restrictions
You agree not to:

  • Redistribute, resell, or modify NebulaClient without explicit written permission.
  • Reverse-engineer, decompile, or create derivative works of the Service.
  • Use NebulaClient for illegal activities or to violate Minecraft’s End User License Agreement (EULA).

3.3 Ownership
Nebula retains all rights, titles, and interests in the Service, including code, trademarks, and intellectual property.

4. Paid Services and Refunds

4.1 Purchases
Premium features may require a one-time payment or subscription. All fees are non-refundable except as required by law.

4.2 Subscriptions

  • Recurring payments will auto-renew until canceled.
  • To cancel, follow instructions on our website or contact support.

4.3 Chargebacks
Disputing charges may result in immediate termination of your access.

4.4 Withdrawal
If you are an EU consumer, you have a statutory 14-day right to withdraw from purchases of digital content. However, by purchasing premium features, you expressly agree that we may begin providing access immediately, and you acknowledge that this waives your right to withdraw once the service has been fully delivered.

5. User Conduct

NebulaClient is designed to enhance your Minecraft experience by providing automation and gameplay modifications. However, you agree not to use NebulaClient to:

  • Disrupt or degrade the experience of other players, including but not limited to interfering with server stability or causing undue strain on multiplayer environments.
  • Violate applicable laws or engage in activities that could result in legal consequences for yourself or Nebula.
  • Misrepresent NebulaClient as an officially endorsed or affiliated modification of Minecraft or any specific server.

5.1 Responsibility
You are solely responsible for how you use NebulaClient. We do not condone or encourage cheating, and any consequences (e.g., bans, penalties) resulting from your use of the Service are your responsibility.

5.2 User Obligations and Conduct
You agree not to infringe upon the rights of third parties or engage in activities that could harm Nebula's reputation.

6. No Affiliation with Hypixel or Other Servers

NebulaClient is not affiliated with, endorsed by, or connected to Hypixel, Mojang AB, Microsoft Corporation, or any other Minecraft servers. Any references to third-party entities are for informational purposes only.

7. Disclaimers

7.1 "As-Is" Service
NebulaClient is provided without warranties. We do not guarantee compatibility, uptime, or error-free operation.

7.2 Third-Party Risks
Use of the Service on third-party servers is at your own risk. We are not responsible for bans, penalties, or other actions taken by server administrators, including but not limited to Hypixel.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.

9. Modification of Terms

Nebula reserves the right to modify these Terms at any time. Significant changes will be communicated to users through email. Continued use of the Service after such modifications constitutes acceptance of the revised Terms.

For any disputes or concerns regarding these Terms, we strongly encourage users to reach out to us via email or our official Discord server before pursuing legal action. We are committed to resolving issues promptly and amicably.

10. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

11. Entire Agreement

These Terms constitute the entire agreement between you and Nebula regarding the use of the Service, superseding any prior agreements or communications.
